Terms of Service

These Terms of Service (hereinafter — "Terms") constitute a legally binding agreement between you ("User") and the owner of the FitGeniusAI service ("Operator"). By using the service, you confirm your full and unconditional agreement with these Terms. If you do not agree, please discontinue use of the service.
FitGeniusAI is an AI-personalized fitness companion providing the following features:
FitGeniusAI is an informational and entertainment service. The service is not a medical device and does not provide medical advice. Before starting physical exercise, especially if you have chronic conditions, injuries, or medical contraindications, please consult a doctor. AI recommendations from the service are for informational purposes only and do not replace professional medical or sports consultation.
By using the FitGeniusAI service, you confirm that:

Creating multiple accounts by one user is prohibited without explicit written permission from the Operator.
When using authorization via VKontakte, Yandex, or Sber, the corresponding terms of service of these platforms apply in parallel with these Terms. The Operator is not responsible for the actions of third parties — OAuth providers.
The User is strictly prohibited from:
All content of the FitGeniusAI service, including source code, AI algorithms, design, logos, texts, and exercise databases, is the property of the Operator and is protected by the copyright and intellectual property laws of the Russian Federation (Civil Code of the RF, Part 4).
Data entered by the user into the service (body parameters, goals, progress) is the property of the User. The User grants the Operator a non-exclusive license to use this data solely to provide the service functionality and improve AI algorithms in anonymized form.
AI-generated workout programs are the result of the service's algorithms and are provided to the user for personal use.

The aggregate liability of the Operator to the User in any case may not exceed the amount paid by the User for the service during the last 3 (three) months preceding the dispute.
During the beta testing period (waitlist), the service is provided free of charge. Commercial subscription terms will be published in this section no less than 14 days before the launch of paid access.
The Operator reserves the right to introduce paid features, notifying users by email. A basic free access tier is planned to be retained after the launch of monetization.
The Operator may suspend or terminate the User's access to the service in cases of:
The User may delete their account at any time by sending a request to dpo@fitgeniusai.ru. Data is deleted within 30 days.
These Terms are governed by the legislation of the Russian Federation, including the Civil Code of the RF, Federal Law No. 149-FZ "On Information, Information Technologies and Information Protection", Federal Law No. 152-FZ "On Personal Data", and the Law of the RF "On Protection of Consumer Rights" No. 2300-1.
Disputes are subject to resolution through a pre-trial claim procedure (response period — 30 days). If no agreement is reached — in courts of general jurisdiction at the Operator's location.
The Operator is released from liability for non-performance of obligations in cases of force majeure: natural disasters, military actions, cyberattacks, actions of government authorities, data center outages, network incidents beyond reasonable control.
The Operator has the right to change these Terms. The current version is published at fitgeniusai.ru/terms. Material changes take effect no earlier than 10 days after publication of the notice. Continued use of the service constitutes acceptance of the changes.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions retain their full legal force.
